Civil recovery - a radical change?

A recent appeal ruling in the Supreme Court has led to the Serious Organised Crime Agency (SOCA) discontinuing a number of civil recovery cases under Part 5 of the Proceeds of Crime Act 2002 (POCA). This ruling has already resulted in a successful outcome for one of our clients.

Suspicious Wills: the rise of ‘want of knowledge and approval’ claims?

A high profile case was heard at the High Court in London recently, in which two Wills prepared by an individual on behalf of his sisters were set aside on the grounds of want of knowledge and approval. We have also just settled a probate dispute where a Will was challenged on this basis. These claims arise when the circumstances surrounding the making of a Will appear to be suspicious. A testator must have knowledge and approval of the contents of a Will in order for it to be valid.

Internet bullying, can it be stopped?

The topic of internet trolling has been in the news recently with a number of stories appearing in the headlines.  The Conservative MP Louise Mensch was subjected to internet abuse by Frank Zimmerman who called her the ‘slut of twitter’ and made death threats against her children.   Mr Zimmerman has now been given a 26 week custodial sentence.
