Home Affairs Committee report: can the Proceeds of Crime be made to pay

On 15 July the Home Affairs Committee published the report of its enquiry into the seizure of criminal proceeds. It highlights a number of on-going failings of the regime and calls for sweeping reforms, for example the establishment of specialist confiscation courts,  the power to impose travel restrictions on those who fail to pay and the continued detention of prisoners until their orders are satisfied in full.

Insider trading: the new market abuse regime

While the current focus of the financial services community could be said to be on the implications of the EU referendum outcome, there is an element of “business as usual” as a key piece of EU financial services legislation, the Market Abuse Regulation (Regulation 596/2014) (MAR), now applies in all Member States as of 3 July 2016.

The Times/Kingsley Napley Student Advocacy Competition

The Times/Kingsley Napley Student Advocacy Competition poses the question “is it time to give anonymity to defendants accused of rape and other sexual crimes?” As a paralegal in the criminal department at Kingsley Napley, I naturally have an interest in this polarising topic. It has the makings of an excellent debate and I am little jealous that I don't qualify to participate. The recent CPS decision with regard to Sir Cliff Richard provides an opportunity to comment on this intriguing debate.

FCA annual report 2015/16: overview of Enforcement, improving standards and the strategic priority to combat Financial Crime

The FCA has issued its annual report and accounts for 2015/16. 

A healthy and successful financial system

The report sets out the FCA’s work in “ensuring we have the right rules and policies in place to ensure that the UK has a healthy and successful financial system.  A financial system where financial markets are fair, efficient and transparent, firms can thrive and consumers have trust in open and transparent markets.”

FCA issues its annual report card

A challenging environment

As the FCA issued its annual report and accounts for 2015-6 it did so in the knowledge that the EU Referendum result called for the United Kingdom to leave the European Union.   No doubt adding an extra element to the reflections on the challenges ahead as set out by FCA Chairman John Griffiths in the report’s opening pages:
