We represented a Claimant in a clinical negligence claim arising from injuries sustained at birth which caused a brain injury. The Claimant’s parent moved the case to us in early 2015 from another firm who had already resolved liability. We settled the quantum claim in early July, very shortly before the trial was due to start. The capitalised value of the settlement was in the region of £28 million.
The Claimant’s cerebral palsy affects all of her limbs, but the Claimant is very bright, and attends a mainstream school.
Some of the issues in the claim involved round the clock care, in particular night care, provision for suitable accommodation, therapies, equipment and technology in order for the Claimant to live as independently as possible throughout their life.
