Cerebral Palsy claim settled in 2018 for in the region of £28m, made up of a lump sum payment and annual periodical payments

We represented a Claimant in a clinical negligence claim arising from injuries sustained at birth which caused a brain injury.  The Claimant’s parent moved the case to us in early 2015 from another firm who had already resolved liability.  We settled the quantum claim in early July, very shortly before the trial was due to start.  The capitalised value of the settlement was in the region of £28 million.

The Claimant’s cerebral palsy affects all of her limbs, but the Claimant is very bright, and attends a mainstream school.

Some of the issues in the claim involved round the clock care, in particular night care, provision for suitable accommodation, therapies, equipment and technology in order for the Claimant to live as independently as possible throughout their life.

Client Feedback:

“I would like to take this opportunity to say how pleased I am with the results of the claim and how impressed I was with all the hard work from Kirsty, Terry and all of the team.

From the moment I first met with Terry I was impressed at how knowledgeable and understanding he was, and felt he wanted to help our family and cared about us as people and not just a paperwork claim. This is the reason I decided to move our case to Kingsley Napley, and it was the best decision I made.

Kirsty worked on our claim from when we first changed over and I am so thankful for all of the hard work, passion and dedication that she showed throughout. Even as a lay person, I can see she is amazing at her work. I feel so lucky to have had Kirsty work with us, and my child will also know just how much she fought for them to have the best outcome.

Kirsty and Terry advised me as if my child was their own, helping to choose the best experts and barristers and I feel so grateful for this.

Kirsty worked tirelessly with me on my witness statements. I feel like she remembered more about my life than I do! That says a lot about how attentive she has always been and how she never missed a detail, which has helped in key points in our case.

Kirsty has been so understanding, kind and patient and has helped me through moments of difficulty when the claim felt overwhelming.

Thank you for spending the time with my child to show them around the Courts on the day of the Approval Hearing.

The work you do is very special, and will change not just my child’s life, but our whole family’s life for the better. It means my child can access opportunities they otherwise would never have been able to, and we will be ever grateful to you for this.”

Client confidentiality is of utmost importance to us.  Due to the particular nature of this case, we are not at liberty to share further details here.  However, if you would like to discuss your own experience please call us directly on 020 7814 1200.
