In session three of the series, we look at the key considerations when dealing with matters post investigation, including:
- Law firm privilege (how best to maintain such privilege and the circumstances in which it may be waived);
- Managing any resulting grievance and disciplinary processes and subsequent exit(s);
- How data subject access requests might arise and responding to them;
- Keeping the SRA updated and handling SRA statutory requests for information (how best to structure and frame the response, including where privilege applies to the material requested);
- Returning to ‘normal’ (how to handle the return to work of the complainant and/or respondent on completion of the investigation); and
- Conducting a “lessons learnt” exercise.
