In session 2, we look at the key considerations when Executing an investigation, including:
- Disclosure (what should be disclosed to whom, when and why);
- Evidence (how best to handle evidence gathered, particularly from a data protection perspective);
- Privacy/confidentiality/security (with a particular focus on the confidentiality arrangements to consider);
- Drafting allegations and terms of reference (including the formulation of rape allegations and the complex topic of consent);
- How best to handle matters involving whistle-blowers and avoid exposure to claims of victimisation;
- Ensuring effective participation (exploring special measures/adjustments to enable the witnesses to effectively participate).
