FCA case against CACEIS UK raises points of interest for practitioners

Tier 2 registered sponsors need to be vigilant to ensure they correctly identify a restricted Certificate of Sponsorship (CoS) before they assign it to a sponsored employee.
Registered Tier 2 sponsors are reminded that the allowances figure indicated on their Tier 2 migrants' CoS must be accurate and remain so throughout the period of sponsorship.
Section 19 of the UK Borders Act 2007 came into force on Monday 23 May 2011 and has the effect of severely restricting the evidence that can be used in appeals against the refusal of points based system applications.
The UKBA announced on 1 June 2011 that it will shortly be issuing new guidance on how applications from EU citizens and their family members should be handled following some recent important decisions of the European Court of Justice (ECJ).
As of 1 May 2011, A8 nationals are now permitted to work in the UK without restriction.
