Removal of trustees – factors a court will consider

Talal Al Zawawi’s jail sentence is a rare example of the Family Division resorting to its punitive function and a private settlement of these very public differences is what is called for.
As if there wasn’t enough to think about in advance of ‘Brexit day’, spouses with English pensions who are divorcing or have recently divorced abroad must take a moment to consider the potential impact of the UK’s exit from the EU on their ability to share such pensions.
Over the years, I’ve encountered many couples in a relationship spanning 20 years or more, often with children together, who have never married nor have any intention of doing so. When challenged as to reasons for not marrying, there’s rarely expressed any aversion to marriage in principle. It’s just, “We’re happy as we are; we don’t need a piece of paper to prove the strength of our relationship”.
January is the month for New Year resolutions and, unfortunately, for some this involves deciding to push forward with the divorce they have been contemplating.
“Divorced Women missing out on Pensions Wealth” - so shouted the headline in the Daily Telegraph on the 7th January 2019, a date coincidentally dubbed “Divorce Day” by the media, so clever positioning by the Royal London to whose Director of Policy, Sir Steve Webb (the former Lib Dem MP and Minister of State for Pensions in the coalition government of David Cameron) the headline belongs.
