Marieta routinely advises officeholders on investigations into the conduct of directors and claims against directors, the recovery and realisation of assets and challenging antecedent transactions in both corporate and personal insolvency estates. Marieta also advises private clients defending claims brought by officeholders.

  • Acting for Liquidators in respect of unlawful dividends and misfeasance claims against the directors of a company for a £1.5million debt to HMRC arising from the company’s participation in an Employment Benefit Trust (EBT) tax avoidance scheme.
  • Successfully defending a private client in a section 423 claim (transaction defrauding creditors) brought by a Trustee in Bankruptcy.
  • Assisting Liquidators of a company involved in a large tax fraud in obtaining freezing injunctions and judgment against the directors and third parties involved in the fraud.
  • Advising a Trustee in Bankruptcy on antecedent claims and successfully recovering 21 properties for the benefit of the bankruptcy estate.
  • Acting for Liquidators on numerous and complex claims relating to misappropriations of money, transactions at an undervalue, breaches of fiduciary duty and fraudulent and wrongful trading.
  • Acting for directors of a company in liquidation, advising on claims brought against them by the Liquidators of the company and successfully securing a settlement with the Liquidators.
  • Advising court appointed receivers and managers of an LLP in successfully seeking directions as to the scope of their powers, the winding up of the LLP on an expediated basis, and the determination of their remuneration; against the backdrop of a highly contentious dispute between members of the LLP, and freezing injunctions obtained as part of that dispute. 
  • Successfully obtaining an order to cure defects in the appointment of joint administrators by the holder of a qualifying floating charge.
