In addition, it reviews important recent cases since the last edition, including:

  • Aquila Advisory Ltd v Faichney & Others - re the limits of the confiscation regime;
  • R v Luckhurst - concerning the inter-relationship between criminal and civil regimes;
  • R v Andrewes - concerning proportionality in the confiscation regime;
  • R (KBR) v DSFO - re limits on the SFO's ability to compel the production of documents.

Alun Milford comments:

Last year, the House of Commons’ Justice Committee reported that we are currently enduring “an epidemic of fraud”. Fraud accounts for over 40% of all crime in England and Wales, but currently attracts only 2% of police resources here. Public confidence in the criminal justice system will be lost if this is allowed to go on, and there are signs that the government is acting on that realisation: the recent inclusion of fraud in the Strategic Policing Requirement was important in that regard.

Our book is intended as a trusty and reliable practical guide for practitioners dealing with cases of criminal fraud. It has been a pleasure to work with Paul and the wider team on it.”
