HMRC no longer reviewing Family Investment Companies
Sponsor Licence Renewals
Those Sponsors who obtained their Sponsor Licence immediately following the introduction of the Points Based System in November 2008, will now be receiving notifications from the UK Border Agency (UKBA) regarding the renewal process. The emails will come from email@example.com and will be addressed to the Level 1 user. Occasionally these emails go into the spam folder and so this should be checked regularly. A further notification will be sent to Sponsors 3 months prior to the expiry date when the renewal function will be activated on the Sponsor Management System (SMS). No documentation will need to be submitted with the application but Sponsors should be prepared to submit any documents which are subsequently requested by the UKBA within 7 days and they may undertake a compliance visit.
The Sponsor summary details on the SMS should be up to date before a renewal application is submitted and so Sponsors will need to ensure any change to the Authorising Officer or Level 1 user has been notified to the UKBA before submitting the licence renewal application. The fees for the application will be £500 for small or charitable companies and £1500 for medium and large companies.
We strongly recommend that Sponsors submit their renewal applications in good time before the expiry date and provided the application and payment is received before the expiry date, Sponsors may continue to sponsor migrants whilst the application is being processed. If the deadline is missed, Sponsors will no longer be able to sponsor migrants and their existing leave will be curtailed. Where Kingsley Napley is your Level 1 user we will ensure that the application is submitted in good time.
EU Children Travelling on Parents’ Passport
EU children must now hold a passport of their own when travelling into or within the EU and can no longer travel with their names listed on a parent’s or guardian’s passport. This requirement is based on EU passport regulations passed in 2009 which provided for a three year transitional period within which Member States should implement the new requirement. This transitional period ended on 25 June 2012. The approach to the expiry of the transition may differ with each Member State and some have confirmed they will observe the provisions of the regulation and implement border controls now that the transition period has expired. You should therefore be aware that carriers will deny boarding if children do not have their own passport.
Temporary Change in Opening Hours at the Metropolitan Police Overseas Visitors Records Office
For those migrants who need to register with the police within 7 days of arrival in the UK, during the Olympic and Paralympic Games (25 July – 10 August and 29 August – 7 September) the opening hours will be 08.00 – 14.30 Monday-Friday.
