Tabassum specialises in tax disputes, investigations and risk management.
She has experience in direct and indirect tax litigation, particularly with employment tax-related enquiries, including IR35 / off-payroll working rules and National Minimum Wage. Tabassum is experienced in resolving complex HMRC enquiries at an early stage, through mediation or negotiation, as well as supporting clients through the Tax Tribunals and the High Court. Tabassum is a qualified member of the Association of Tax Technicians (ATT).
Her areas of expertise include:
- Tax disputes and investigations;
- HMRC enquiries into IR35 issues, including worker classification and status determinations;
- National Minimum Wage issues, including salary sacrifice schemes, holiday pay, uniform requirements and unpaid working time;
- Voluntary disclosures for corporate and high net worth individuals;
- Resolving complex HMRC enquiries through Alternative Dispute Resolution;
- Information requests under Schedule 36 of Finance Act 2008.
Recent experience
- Acting for high net-worth individuals with unprompted voluntary disclosure of undeclared income, preparing detailed background to disclosure in order to mitigate penalties and limit scope of further enquiry;
- Acting for recruitment companies and retailers with National Minimum Wage concerns regarding operation of salary sacrifice scheme, unpaid working time and requirement to wear uniform;
- Advising on IR35 and off-payroll working rules to employers and agents who have engaged highly skilled individuals, resolving disputes over employment status and claims of unpaid National Insurance Contributions;
- Advised high net-worth individuals on their statutory residence position, liaising with HMRC regarding analysis of UK day count and application of SRT tests.
