The legal challenge against the government’s VAT policy on private education will be heard by the High Court from 1-3 April 2025.
Kingsley Napley is representing the lead claimant group of seven families, supported by the Independent Schools Council, and the claim seeks a Declaration of Incompatibility on the basis that the policy is incompatible with Article 2 of the First Protocol (right to education) of the European Convention on Human Rights read on its own, and when read with Article 14 (protection from discrimination).
The case is being heard by a Divisional Court consisting of three judges.
