Although many cases often contain an element of police involvement, the police/CPS will apply criminal tests and thresholds as clearly defined within statute and case law. Students should be aware that even when there is not sufficient evidence for criminal charges to progress, or where a complaint is not made to the police; universities are able to undertake their own investigations, bring matters before a hearing panel and take disciplinary action where required. The threshold for these proceedings is much lower, being the civil standard of proof - “on the balance of probabilities”.
