CONSENT MATTERS – Setting the standard for respect and boundaries whilst at university (and steps to take if things go wrong)

The Regulatory team at Kingsley Napley LLP are frequently instructed by university students involved in disciplinary proceedings relating to sexual misconduct. Although many cases often contain an element of police involvement, the police/CPS will apply criminal tests and thresholds as clearly defined within statute and case law. Students should be aware that even when there is not sufficient evidence for criminal charges to progress, or where a complaint is not made to the police; universities are able to undertake their own investigations, bring matters before a hearing panel and take disciplinary action where required. The threshold for these proceedings is much lower, being the civil standard of proof - “on the balance of probabilities”.

Key changes to ICAEW Professional Indemnity Insurance requirements

In December 2023, the ICAEW Regulatory Board, along with the Professional Indemnity Insurance Committee (PIIC), began reviewing ICAEW's insurance requirements. A consultation on the proposed changes was held from 18 October to 14 December 2023. After reviewing the feedback, the ICAEW have confirmed changes to the Professional Indemnity Insurance (PII) regime to take effect on 1 September 2024. The GMC regulation of Medical Associate Professionals on the horizon

The role of Physician Associates (PAs) and Anaesthesia Associates (AAs) are still considered to be relatively new, but they have been practising in the NHS since 2002 and 2004 respectively. As of June 2023, there were 73 Full Time Equivalent (FTE) AAs and 1,508 FTE PAs working in NHS Trusts and other core organisations. A further 1,707 FTE PAs were working in GP practices and primary care networks. The NHS Long Term Workforce Plan aims by 2036/37 to have established a workforce of 10,000 PAs and 2,000 AAs.
