Breaking Boundaries – the sequel

Will a new scheme for Birth Injury Compensation work?

Jeremy Hunt is due to make a speech today which sets out proposals to offer compensation automatically to parents of still born or brain damaged children when those injuries have arisen because of substandard care.

Stopping the stigma of childbirth injuries

It is encouraging that the popular BBC’s Victoria Derbyshire programme, which focuses on news and current affairs, chose to devote a feature this week to the often hidden trauma of suffering perineal tears caused by childbirth.  As clinical negligence solicitors, we frequently hear from women that their symptoms have been exacerbated by poor care, delay in diagnosis and sadly, lack of awareness about the problem.

Kingsley Napley celebrates World Cerebral Palsy Day 2016

World Cerebral Palsy (CP) Day recently took place on 5 October 2016.  To mark the occasion, members of the Kingsley Napley Clinical Negligence team attended an event hosted by the London Centre for Children with Cerebral Palsy (a World CP day partner).

Reaney -v- University Hospital of North Staffordshire NHS Trust The sequel: a further judgment but still riddled with uncertainty?

On 8 August 2016 Mr Justice Foskett handed down the latest in a series of judgments that have been given on this long running case, Reaney -v- University Hospital of North Staffordshire NHS Trust.  In November 2015 the Court of Appeal determined an issue of law and referred the case back to Mr Justice Foskett (the trial judge) for the quantification of Mrs Reaney’s damages.  Unfortunately the latest judgment did not resolve the outstanding quantum issues and the parties were sent away to attempt to agree a "satisfactory settlement" to avoid the need for further written submissions or another hearing.
