2025 in review: Under construction - Tax investigations

The UK Border Agency (UKBA) has now confirmed that employees in the UK under the Tier 2 intra-company transfer route (ICT) can apply to remain here beyond five years if their initial visas were granted before 6 April 2011.
The immigration rules are not currently clear on this point, but the UKBA has clarified the issue. This provides clarity to employers that employees who initially entered the UK with Tier 2 (ICT) leave and cannot or do not wish to apply for indefinite leave to remain once they have been here for the five year qualifying period, can apply to remain in the UK under Tier 2 (ICT) nonetheless.
