Kingsley Napley LLP has learnt that the UKBA is looking again at its approach to the new exclusion periods that apply to Tier 2 (ICT) assignees.
Under the rules in force since 6 April 2011, when an individual with a salary of at least £40,000pa is transferred to the UK on a long-term basis they are subsequently excluded from applying to return to the UK under the same route for 12 months from the end of their Tier 2 (ICT) visa. The initial visa can be valid for a period of up to three years, but cannot be cancelled if an assignee leaves the UK early or plans change before he enters the UK.
