Sight loss in one eye leading to damages recovery of £125,000. The patient in their early 70s repeatedly attended a private doctor with intense pain in one eye. Although a diagnosis of optic neuritis was made, there was a failure to arrange intravenous acyclovir treatment as an inpatient or oral equivalent treatment as an outpatient. There were subsequent failures to follow up or to arrange aqueous or vitreous sampling to identify the viral agent. As a result of the failings the Claimant was left permanently blind in one eye suffering from heightened sensitivity discomfort and occasional pain with significantly deteriorated cosmetic appearance to the eye.
The loss of the eye sight has significantly impaired daily activities.
The case was settled before trial.
