Claim settled for delay in diagnosing spinal epidural haematoma

Terry Donovan and Aideen McGarry successfully settled a claim for the family of Mr A, a man in his 70's who suffered a life changing spinal injury as a result of a delay in diagnosing and treating a spinal epidural haematoma, following a fall at home.

We argued Mr A should have undergone emergency surgery to decompress the haematoma (which was compressing his spinal cord) within 12 hours. Devastatingly for Mr A, this did not happen and he was rendered paraplegic. He also suffered from debilitating related issues, including problems with his bowel and bladder function, and pressure sores which left him bed bound for extended periods of time.

Very sadly Mr A died from cardiac arrest almost 5 years after suffering his spinal cord injury. We argued complications relating to his spinal cord injury caused or contributed to his death.

Full admissions of liability were not made and the parties were strongly opposed on the issue of what Mr A’s condition would have been if he had received early surgery.

We were, however, able to settle the case without going to trial for a significant sum.
