Global Business Mobility visa routes

From 11 April 2022 the Global Business Mobility routes provide various ways for an overseas business to operate in the UK.  These include the transfer of key staff, expanding your business into the UK, supplying a service under an international trade agreement and secondments for high value contracts and investments.

Global Business Mobility has five sub-categories:

1. Senior or Specialist Worker – previously known as the Intra-Company Transfer (ICT) (and Tier 2 (ICT)) route, this category is for staff employed outside the UK at a connected group company who are transferring temporarily to work in the UK. This new category operates in much the same way as the previous ICT routes and is useful for where an applicant cannot meet the English language requirements for a Skilled Worker application.

2. Graduate Trainee – previously known as the ICT – Graduate Trainee category is for staff employed outside the UK at a connected group company on a graduate training course. Such employees are able to come to the UK as part of their graduate training/work placement with a view to then taking up a senior management or specialist position outside the UK.

3. UK Expansion Worker – this category is for an overseas business seeking to establish itself in the UK. Senior/specialist employees of the overseas business can come to the UK to set up the UK branch or subsidiary. This category has replaced the representative of an overseas business (sole representative) category. Those with existing visas in the predecessor category can continue to extend their stay or apply for settlement (indefinite leave to remain).

4. Service Supplier – is for overseas workers who are either a contractual service supplier employed by an overseas service provider or a self-employed independent professional and they are providing services covered by one of the UK’s international trade agreements. These provisions were previously in the International Agreement category.

5. Secondment Worker – this is a new route for overseas workers being seconded to the UK as part of a high value contract or investment (worth at least £10 million per year and at least £50 million overall) by their overseas employer.

Applying for a sponsor license

All of the sub-categories require the business to apply for a sponsor licence and meet strict compliance and audit responsibilities.

Other options and services

We can advise on the best routes to use for your business and help plan for your future immigration needs. None of the Global Business Mobility routes lead to settlement (indefinite leave to remain) and so you may wish to consider longer term solutions, such as applying for a Skilled Worker sponsor licence application.

Whether you are a start-up business in the UK or more established, you can also benefit from additional advice from our corporate team such as on the registration of the new UK legal entity with Companies House in the UK and our employment team for the drafting of a suitable assignment agreement and UK employment contract. You may also require assistance with sourcing suitable premises and again, our Real Estate team are well placed to assist you with this. We are able to provide you with the whole suite of legal services in one place, to ensure the smooth transfer of key staff to the UK.
