Investigations and Prosecutions

The fire and rescue service can prosecute individuals or corporates for failures to comply with fire safety under the Regulatory Reform (Fire Safety) Order 2005.  A failure to comply with the Order can carry a penalty of a substantial fine or up to two years imprisonment.
 

Prosecutions can also be brought by the Health and Safety Executive (“HSE”) under the Health and Safety at Work etc Act 1974 (“HSWA”).  Corporates and Directors could face significant fines or terms of imprisonment for offences under both the Fire Safety Order and the HSWA.

As part of the investigation, the fire and rescue service or HSE may invite you to an interview under caution.  You are entitled to have a legal representative with you at such an interview.

Should you be invited to an interview under caution we can assist you in preparing for the interview, including the appropriate strategy in responding and preparing documentation as appropriate. We will liaise with the relevant authority in relation to disclosure.  We can We will attend the interview with you and provide support before, during and after the interview process.
