In session 2, we look at the key considerations when executing an investigation, including:
- Disclosure – what should be disclosed, to whom, when and why.
- Evidence – how best to handle evidence gathered, particularly from a data protection perspective.
- Privacy, confidentiality and security – with a particular focus on the confidentiality arrangements to consider.
- Drafting allegations and terms of reference – including the formulation of rape allegations and the complex topic of consent.
- How best to handle matters involving whistleblowers and avoid exposure to claims of victimisation.
- Ensuring effective participation – exploring special measures and reasonable adjustments to enable witnesses to participate effectively.
