Changing your Deputy

If you lack capacity and need the support of a deputy to manage your financial affairs then it is essential that you are working with the right person as they have such an important role to play. Do they really take account of your wishes? Do they seek to impose their own values and judgements on how your affairs are managed? Many people don’t realise that the situation does not have to be like that and you can change your deputy if you wish.

A deputy is appointed by a court order and only the Court can decide who that should be. The process of appointing a deputy can take several months but if the relationship isn’t working you are not obliged to stay with the same deputy. As with any relationship, there can be a clash of personalities and sometimes change is necessary.

Our highly experienced Court of Protection team is led by Simon Hardy, who  has acted for many clients in many different circumstances for over 15 years, at the leading firms in the country for this work. Simon does not pretend that he fully understands everything you are experiencing or how your life is affected by a loss of capacity – but he will listen to you and he won’t make assumptions about what you want or need.
