Louise Hodges, head of criminal litigation at Kingsley Napley LLP, said the “adequate procedures” required under the act differ depending on the size of the organization. The industry a company operates in, and the risk its business is exposed to, can also affect what counts as adequate under the law.
“Ultimately only the courts can determine whether a company had reasonable prevention procedures in the context of the facts of a particular case,” Hodges said.
