Birth Injury Claims: Hypoxic Ischaemic Encephalopathy

Terry Donovan and Aideen McGarry acted for a young woman who suffered a serious infection following delivery of her baby by caesarean section and was prescribed a strong antibiotic called Amikacin. However, our client was given a much higher dose that she should have been and went on to suffer permanent and irreparable damage to her hearing and balance. This, understandably, caused very serious distress and our client was diagnosed with post-traumatic stress disorder (PTSD).
A claim was made against the treating hospital for the overdose. The case also included allegations for a catalogue of errors in relation to our client’s obstetric care and management of her infection. Whilst some admissions were made by the hospital, these were not full and primarily, while they agreed that the overdoes of Amakacin was an error, they did not accept that this caused the damage to our client’s hearing or balance or her psychological injury.
Nonetheless, a good outcome was obtained and Kingsley Napley successfully settled the case without court proceedings for £220,000.
