JUDICIAL REVIEW

For a company it is important to know the constraints on public authorities whose actions and decisions impact on your business and to know how, if needs be, most effectively to bring a judicial review challenge against an authority. Conversely, public bodies need to be clear as to the full extent of their powers and how to exercise them properly and to be in a position vigorously to defend any judicial review proceedings brought against the body.

Our team – which includes two former senior central government lawyers – has very extensive experience both in acting in and in seeking to avoid judicial review litigation. We have in depth knowledge of all aspects of judicial review, including human rights law and work cross departmentally, combining the expertise of our public law team with that of lawyers in other practice areas to ensure that we deliver focused and practical advice.

Acting for the Law Society in its successful challenge to the Ministry of Justice’s decision to limit the costs recoverable by acquitted defendants in criminal cases

Acting for JD Wetherspoon in successfully resisting a challenge in connection with the “Pubwatch” scheme

Acting for an invidual, mandated by the UNHCR as a refugee, in his successful challenge to the UKBA’s refusal to permit him to settle in the UK
