Legal Defence for Dentists

Our specialist regulatory lawyers bring their experience of having acted for a number of healthcare regulators (including the General Dental Council (GDC)) to the work we undertake on behalf of our dentist clients; this rounded perspective ensures that we are able to identify realistic outcomes and the most effective routes to achieving them; we have a proven track record of securing better than expected results in fitness to practice proceedings before the GDC, particularly in cases of alleged sexual misconduct and dishonesty.

Through our work in the health and social care field, we understand the commercial pressures that dentists face in this time of increasing regulation, increasing patient choice and uncertainty, both within the NHS and in private practice. We recognise that a complaint made about a dental professional may have financial, reputational and other professional consequences and at worst, threaten their ability to earn a living. When faced with a complaint made to the GDC, we work with our clients to establish a clear strategy from the outset: we prepare robust defences to disputed allegations and, where necessary, we gather and present tailored, targeted and convincing mitigation, which very often changes the predicted course of a case, for the better.

The best time to take legal advice when facing a complaint is before you engage with the GDC. Our work with dentists in the initial phases of an investigation allows us to protect their interests right from the start; our focus is then to seek to have appropriate cases closed at Case Examiner stage. Our key priority when representing dentists that are referred to a hearing before the Professional Conduct Committee or the Health Committee of the GDC is to seek to achieve the difficult balance between engaging professionally and demonstrating any necessary insight, whilst robustly challenging unfairness, misunderstanding and misstatement.

We are well versed in advising dental practices and our work for dentists often brings in teams from around the firm, including employment, real estate, corporate and commercial and the criminal litigation team. Our dental lawyers are independent of any defence organisation and/or insurer.
