Future immigration system for individuals

The Brexit transition period ended at 11 pm on 31 December 2020.  EU citizens in the UK by that date will be able to apply to the EU Settlement Scheme.

From 1 January 2021, both non-EU and EU citizens need to apply under the new immigration system.  Whilst the Skilled Worker category rules are clear for those who have a job offer from a UK company, there are not currently any new categories of application for individuals without a job offer.  Like non-EU citizens, EU citizens will need to apply under the existing available categories, including Tier 1 (Investor), Global Talent, Start-up and Innovator or as a family member

The government is developing a new unsponsored points based category (possibly called the elite category) for highly skilled individuals without a job offer and it is likely to be implemented in 2022.  The new category may be subject to a quota and points will be awarded based on individuals’ education, age and STEM subject skills.
