Cash Seizures, Restraint Orders and Confiscation Proceedings

"They are a really outstanding firm - their POCA and asset forfeiture work is absolutely first-class."

Chambers and Partners 2019

Our team of specialist criminal defence lawyers are experienced in advising individuals and corporations subject to investigation or proceedings where their assets have been restrained or frozen by the civil or criminal courts.
We also advise in relation to confiscation orders and third party applications in respect of property caught by a confiscation order.
We understand the importance for individuals and companies of minimising the effect of restraint and freezing orders. In appropriate cases, we can apply to the Court for these orders to be discharged or varied to ensure that our clients can continue their normal lives within the constraints of the orders.
It is essential to obtain immediate advice in respect of any restraint order as they have short time limits within which statements must be made and assets repatriated and access to funds is immediately limited.  These orders are draconian, but with advice they can be managed.  Any statements made will be used in the event of a conviction and it is therefore essential that they are correct.  Non-compliance with an order is Contempt of Court or, sometimes in the most serious of cases, viewed as perverting the course of justice.
We can guide you through every step of the process. From responding to the initial order and the considerations that need to be made to ensure that the living allowance is sufficient to meet your needs, to preparing for a criminal trial and advising on confiscation proceedings in the event of a conviction.  These proceedings can take years and our team of lawyers will be able to assist you throughout.

They are a really outstanding firm - their POCA and asset forfeiture work is absolutely first-class.
