Is a solicitor under a duty to warn their client of risks falling outside their retainer?
Specialist litigation firm Kingsley Napley today announces the appointment of Fiona Simpson, an expert in civil fraud litigation, as a partner in its Dispute Resolution practice.
Fiona joins Kingsley Napley from Withers LLP bringing with her a wealth of experience acting on civil and criminal fraud cases including acting for a UK company, its directors and shareholders defending allegations of advance fee fraud, defending a high-profile individual facing multiple directors’ disqualification proceedings, defending an individual and a firm in civil fraud proceedings relating to unauthorised payment of monies held in escrow, and obtaining a freezing order against a firm of accountants and one of its directors who had removed monies from a number of clients' trust accounts.
Fiona is recommended in The Legal 500 as an expert in her field and is described as “very assured” and “incredibly hardworking”.
Her arrival complements Kingsley Napley’s substantial experience in fraud. The civil fraud practice is currently acting on a number of matters for well-known clients including representing a financial institution based in the Middle East, a high-profile entrepreneur and company director, and one of the largest casino operators in the UK. In 2013, Kingsley Napley’s Dispute Resolution practice was appointed to the Solicitors Regulation Authority litigation panel following a competitive tender process and is currently representing it in a complex civil fraud claim as well as many other contentious matters.
Linda Woolley, Managing Partner at Kingsley Napley, said:
“We are delighted to welcome Fiona to the partnership. Her addition to the team will strengthen and enhance our fraud offering to clients. She and the rest of the civil fraud team will work alongside our criminal litigation specialists to advise both defendants and claimants on all aspects of fraud cases.”
