Proposed changes to settlement to be retroactive

We reported last week on the consultation the UK Border Agency (UKBA) is currently carrying out on its proposed changes to the settlement system in the UK. Interested clients are encouraged to participate in the consultation to protect the right of skilled workers to obtain permanent residence in the UK.

Employers should be aware that the new settlement proposals would affect all those who entered the UK from 6 April 2011. Sponsors who have brought employees to the UK under Tier 2 (General) since that date should warn them that the individual and family members may only be able to stay for five years if the sponsored worker receives a salary package of less than £150,000pa.
