A nervous disposition
Our client’s mother had instructed solicitors to prepare her will, which they sent out to her for signature and which she returned to them witnessed but unsigned by herself. The solicitors did not notice the error and so after her death an intestacy arose and our client did not inherit her estate as she had intended.
The solicitors’ negligence in failing to check that the will had been properly executed resulted in significant loss to our client. Through pre-action correspondence we secured a significant and favourable settlement sum from the solicitors, using our expertise in the cross-over between probate disputes and professional negligence claims.
