Is a solicitor under a duty to warn their client of risks falling outside their retainer?
The client had previously obtained their own sponsor licence. Their employee was working in a sub-entity that belonged to the firm but was not included on their sponsor licence.
Working to a very tight deadline, we liaised with senior UK Border Agency (UKBA) staff to negotiate an addition to the client’s sponsor registration of the new sub-entity, a process that would have taken months otherwise. This allowed an Intra-company transfer between the sub entity and the client to take place.
