Director’s disqualification

Insolvency Litigation

We acted for an individual against whom directors’ disqualification proceedings had been brought.  The allegations relied on were made by our client’s former co-directors with whom he was engaged in litigation and who would benefit from him being tied up in another piece of litigation in order to put pressure on him to settle the dispute with them.

We analysed and responded robustly to the proceedings, not only providing evidence to disprove the allegations, but also pointing out the motivation of the former co-directors and the issues with their credibility if they were the sole witnesses in the disqualification action against our client.

We were able to successfully negotiate the discontinuation of the proceedings with a very substantial contribution made towards our client’s legal costs.
