Our high profile client took steps to pursue a claim against an upmarket property agent for breaching their duty of care in allowing an individual access to our client’s property for a viewing which resulted in a theft.
We argued that the agent was responsible for ensuring that enhanced due diligence was carried out in relation to any perspective buyers visiting the property and that the agent had a duty to ensure that anyone attending the property was supervised for the duration of the visit. In failing to do so, the agents were in breach of their duty to our client and consequently were liable for the loss suffered.
The claim was settled on a highly confidential basis on favourable terms to our client.
