‘De-risking’ and financial exclusion
We acted on behalf of a commercial property client in relation to a professional negligence claim against its building surveyor arising from the purchase of a factory building.
The surveyor failed to notice the existence of asbestos during the inspection of the building. The potential losses in this claim were significant but the difficulty with this type of case is assessing whether a reasonable surveyor would and should have identified the existence of the defect (i.e. the asbestos).
In this case, were able to successfully establish liability and secure a swift and favourable outcome for our client.
