Details of Respondents to Employment Tribunal claims to be published

Date: 14th October 2008
Categories: Employment

The Information Commissioner's Office ("ICO") has ruled that the names and addresses of all Respondents to Employment Tribunal claims must be made public.  The ICO ordered that the Department for Business, Enterprise and Regulatory Reform ("BERR") must release the material under a Freedom of Information Act request.

BERR argued that releasing the information was not in the public interest and provided examples of harm that it considered publication of these details would cause, including that it may leave Respondents at risk of unwarranted damage to their reputation.

However, the ICO concluded that the public interest in disclosing this information outweighs the public interest in keeping it confidential, so the material should be disclosed if requested.
