Family breakdown is an unwelcome reality for many people who move countries for work or other reasons.  If it happens, UK law may be more beneficial than the law of your home country to one or both parties involved.  Particular considerations for US clients might include the treatment of premarital or inherited property which, unlike in many US states, is often included in the calculation of assets available for division by the UK courts on divorce.  Spousal maintenance (alimony) is also perceived to be more generous in England and Wales than in many other jurisdictions. 

We offer a full range of family and matrimonial services, including advice on divorce, complex financial issues, disputes over children, cohabitation issues, prenuptial agreements and child abduction.  We have extensive experience of cases with an international element and frequently work with lawyers in the US, to assist our clients in choosing the most favourable jurisdiction for them.

We have particular expertise in drafting international prenuptial agreements. Although prenuptial agreements are not strictly binding in England and Wales, it is clear from recent case law that they are becoming more and more influential to the Courts on divorce, particularly when certain safeguards are followed. We will ensure that best practice is followed with any English prenuptial agreement, in order to maximise the client's ability to protect their wealth.
