Tier 2 of the Points Based System allows employers to bring foreign migrants to the UK to work for their organisation.
Under Tier 2, employers are required to register as a Sponsor and prospective employees are required to pass a “points assessment”. An employer sponsors a migrant and is accountable for ensuring their eligibility and compliance.
Our role is to guide you through the Points Based System and provide creative solutions to give you the best opportunity to hire the best people to make your business successful.
We support employers by working with you to understand your business needs and how these interface with the Points Based System. We will review your current recruitment and HR policies, systems and practices to identify any areas for improvement and then recommend changes to ensure compliance with Sponsor duties under the Point Based System.
We provide immigration advice and support to employers at all stages, including:
- preparing for and submitting the Tier 2 Sponsor Licence Registration application;
- issuing Certificates of Sponsorship (COS) through the Sponsor Management System (SMS);
- establishing clear processes to gather relevant information/documentation and to ensure compliance under the Points Based System;
- evaluating new hires and intra-company transfers under Points Based System criteria;
- supporting migrants during the entry clearance (visa) process;
- submitting Indefinite Leave to Remain (ILR) applications for employees upon eligibility (five years of continuous work) and if required;
- assisting with responses to any government consultation papers on immigration which may affect your business.
- detailing a business case for additional Certificates of Sponsorship under the current Points Based System limits;
- reporting, on your behalf, to the UK Border Agency (UKBA) about the usefulness of Tier 2 and any suggestions for change; and
- assisting with responses to any government consultation papers on immigration which may affect your business.
Our ongoing client support includes:
- tailored training to your HR or recruitment teams on the responsibilities and requirements for sponsoring employees under the Points Based System;
- regular updates on changes to the Points Based System via previously agreed set meetings, seminars and alerts; and
- an annual review of your sponsored employees' files to check compliance with duties under the Points Based System including record keeping, new employee checking procedures and reporting and recommending changes.
