There is only one ground for divorce or the dissolution of a civil partnership; the irretrievable breakdown of the marriage or civil partnership based on one of the following facts:

(a)    Adultery (divorce proceedings only)
(b)    Unreasonable behaviour
(c)    Desertion
(d)    Separation for two years (with the other’s consent)
(e)    Separation for five years

The mechanics of obtaining a divorce or dissolution are usually quite straightforward, particularly if the couple agrees that the marriage or civil partnership is over. Difficulties tend to arise when resolving the practical issues such as the manner and timing of the physical separation, arrangements for the children and finances.
