Collaborative law is a relatively new process which aims to assist the separating couple to reach an agreed settlement based upon a series of round table meetings involving you, your partner and your respective lawyers.
The process works by you, your partner and your respective lawyers signing an agreement stating that it is your intention to reach a settlement without going to court. You agree, if the process breaks down, that you will both instruct new lawyers. There is therefore a strong incentive for everyone to strive towards reaching an agreed settlement and resolution.
The fact that negotiations take place face to face rather than by letter or litigation means that a separating couple have control of the process. The objective is an amicable settlement that is right for the couple or family as a whole and reflects the fact that, post divorce or separation, many couples will need to maintain a relationship particularly if they have children.
Collaborative law methods can also be used when negotiating prenuptial agreements.
