The Human Fertilisation and Embryology Act 2008 has amended, with effect from April 2010, the category of people who can apply for parental orders, following a surrogacy arrangement; for example, civil partners can now apply for parental orders. This Act has also made crucial amendments to the definition of a 'parent' with the result that it will be possible for a child to have two legal parents who will not need to be, respectively, the child's mother and father. We will be able to advise in relation to these changes and the appropriate legal steps to be taken by same sex couples who have a child via a surrogacy arrangement.
