Battersea Heliport

Kingsley Napley advised Von Essen Investments Limited in relation to the terms upon which it was to take Leases of parts of a 13 storey mixed use development adjacent to the River Thames in Battersea involving flats, restaurant, office and hotel accommodation and all consequential rights arising from the use of parts of the building for these purposes together with a negotiation of the appropriate terms in the Development Agreement by which the landowner/developer is to construct the building and associated infrastructure.  This was in conjunction with another group company's acquisition of the adjoining Battersea Heliport for whom the Corporate Department of Kingsley Napley acted.  The principal commercial issues related to the contractual obligations that were imposed upon the landowner/developer in order to ensure the delivery of the end product within an agreed time frame and the terms of the several leases for the different elements in the building all of which had their own unique requirements.  Other complex issues related to the resolution of access over a private roadway, the consequential servicing of the development site and the Heliport and the ongoing planning issues relating to variations to the design and extent of the development being undertaken by the landowner/developer.
