Divorce and Family Breakdown

Finances

Most divorces and separations involve consideration of the family's financial arrangements (for example the family home, payment of maintenance, family owned businesses etc).  A number of factors are taken into account;  including the length of marriage, the ages of the parties, their incomes and earning capacities.    Contrary to common perception, there is no automatic 50-50 division of the family's assets and we can advise you as to the likely settlement achievable including the court process, negotiation, collaboration and mediation.

It is becoming more and more common for people to move around the world or hold assets in other countries.  The need has therefore never been greater for advice on the impact of the laws of other jurisdictions.  We have contacts with lawyers around the world who can help us to act quickly on your behalf.

If you believe your spouse has disposed (or intends to dispose) of assets without your agreement, we can make emergency applications to the Court to protect your position, whether those assets have been disposed of in this country or abroad.  We can also assist if your spouse has obtained an Order against you preventing you from disposing of your assets.

Our advice will be given hand in hand with tax expertise from our Private Client team and, if necessary, we will call upon the services of actuaries and pension advisers.
