Public and Private International Law and International Judicial Co-operation
Many of the firm's cases have an international dimension, perhaps because of the location of the parties, their assets or the jurisdictions in which the material events took place.
We advise regularly on jurisdiction and conflict of laws issues, sometimes with the assistance of foreign lawyers with whom we have established relationships. In addition, foreign lawyers often ask us for advice or assistance in connection with civil proceedings that are taking place abroad.
Services we offer in connection with foreign disputes or proceedings include:
- Advice on jurisdiction and conflict of laws
- Provision of expert evidence on English law and procedure
- Service of foreign proceedings
- Applications for anti-suit injunctions
- Applications for freezing orders, including worldwide freezing orders
- Recognition and enforcement of foreign judgments
- Obtaining testamentary and documentary evidence for use in foreign proceedings including the taking of depositions
- Appeals to the Privy Council in civil, criminal and constitutional matters
Notable Cases
- Assisting an American Claimant pursuant to the terms of a Letter of Request issued by an American Court, in obtaining testamentary and documentary evidence from a Witness resident in England
- Representing an Indian client against a Costa Rican Defendant in a claim for fraudulent misrepresentation and obtaining a worldwide freezing Order to prevent anticipated dissipation of assets by the Defendant
